2014-2015 Resolutions

Resolution 2014-2015-1 Amend the Definition of Faculty and Eligibility for Election to the Faculty Senate in the Bylaws of the Faculty Constitution

Whereas, Section I of the Bylaws of the Faculty Constitution defines faculty as follows:

  1. Persons employed full-time by the University of Central Florida during the regular calendar year are members of the general faculty if they hold one of the following academic titles:
    1. Professor, Associate Professor, or Assistant Professor(including faculty with clinical or research appointments).
    2. University Librarian, Associate University Librarian, or Assistant University Librarian (professional librarians of comparable rank to those listed in Bylaws, Section I.A.1).
    3. Lecturer.
    4. Instructor or Instructor Librarian; and

Whereas, Section II. Senate Membership, specifies members of the general faculty who are eligible to be elected to the Faculty Senate as follows:

  1. General Eligibility

    Those defined as members of the general faculty in Bylaws, Section 1.A shall be eligible to be elected to the Faculty Senate, with the exception of Lecturers, Instructors, and Instructor Librarians. Visiting faculty, regardless of their rank or duration of appointment, are not eligible to serve on the Faculty Senate.; and

Whereas, new ranks were created in order to establish a promotion pathway for Instructors and Lecturers; therefore

Be It Resolved that the new ranks of Associate Lecturer, Senior Lecturer; Associate Instructor, and Senior Instructor shall be added to the Section I. Definition of Faculty and to Section II. Senate Membership, A. General Eligibility in the Bylaws of the Faculty Constitution.

SECTION I. Definition of Faculty

  1. Persons employed full-time by the University of Central Florida during the regular academic year are members of the general faculty if they hold one of the following academic titles:
    1. Professor, Associate Professor, or Assistant Professor(including faculty with clinical or research appointments).
    2. University Librarian, Associate University Librarian, or Assistant University Librarian (professional librarians of comparable rank to those listed in Bylaws, Section I.A.1).
    3. Senior Lecturer, Associate Lecturer, or Lecturer.
    4. Senior Instructor, Associate Instructor, Instructor, or Instructor Librarian.

SECTION II. Senate Membership

  1. General Eligibility

    Those defined as members of the general faculty in Bylaws, Section I.A. shall be eligible to be elected to the Faculty Senate, with the exception of Senior Lecturer, Associate Lecturer, Lecturer, Senior Instructor, Associate Instructor, Instructor, and Instructor Librarian. Visiting faculty, regardless of their rank or duration of appointment, are not eligible to serve on the Faculty Senate.

Resolution 2014-2015-2 Parental Leave Policy and
Procedures for UCF Faculty Birth/Adoption
(Not Approved)

Whereas, it appears that current UCF policies do not provide for parental leave for faculty for birth or adoption; and:

Whereas, provision of parental leave for faculty birth or adoption has been inconsistently given and allowed on an ad hoc basis and a variety of options have been used including:

  1. Requiring parental leave be given to the mother only; and/or
  2. That accrued sick leave be used (which creates additional hardship on recently hired faculty); and/or
  3. Modified instructional duties (MID) for faculty are:
    1. Not allowed; and/or
    2. Allowed only for faculty who have been employed at UCF for a minimum of one year; and/or
    3. Required to continue non-instructional duties such as research/grant work and/or service; and

Whereas, having a paid parental leave policy for faculty at UCF is needed for the competitive recruitment, hiring, and retention of faculty; and

Whereas, another university in the SUS, the University of South Florida, since 2010, has offered paid parental leave that provides parental leave for birth/adoption; therefore

Be It Resolved that the Faculty Senate of the University of Central Florida encourages administration to work with UFF-UCF to develop equitable, consistent policies and procedures to provide parental leave for birth/adoption by faculty; and

Be It Further Resolved that the Faculty Senate of the University of Central Florida recommends that any development of Parental Leave Policy consider and address the list of examples and conditions identified in Attachment 1: Parental Leave Examples and Conditions.

Attachment 1: Parental Leave Examples and Conditions

Example of types of leave, duration, funding, etc. to be considered as part of Policy on Parental leave for faculty experiencing birth or adoptions:

  1. Paid leave be provided for the parental leave for birth/adoption
  2. Both partners be allowed parental leave at alternate times
  3. The leave duration be a semester (up to 19.5 weeks)
  4. Such leave be available to recent and long-term faculty irrespective of length of employment at the university and that
    1. If the faculty member is lacking sick leave at the time of birth/adoption, leave be provided and later deducted from accrued leave when the faculty member earns it
    2. Upon separation from the university, if the faculty member is to collect any amount of unused sick leave, that paid parental leave be deducted before reimbursing the faculty member

Returned by Provost Whittaker on March 4, 2015:

"While I am generally in favor of policies which support provisions for parental leave during the birth or adoption of children, this is a subject that falls under the legal purview of collective bargaining. Upon conferring with the UCF BOT Collective Bargaining Team, I was informed that there is currently a proposal covering parental leave that the BOT and UFF teams are currently negotiating. As such, I must refrain from approving this Resolution."
